  1. he should have been found gulity of 1st degree, not by premediation but under section c or d, but then you would have to prove that there was a sexual assault at the time of death and since many of the women had been long dead and decomposed, it would be very difficult to prove beyond a reasonable doubt.
  2. the question is intent and what was his mind set. assuming each girl went to his place to offer services at separate times. the crown would have to prove that he had the intention to kill each one prior to getting them back to his house. ie: while picking her up at the corner and taking her back, perhaps his intent was just to have sex, he wanted to do something she didnt and in the heat of the moment, he killed her. that would be 2nd degree... just because he killed one we cant infer that he planned to kill the next one. also since he had not been convicted yet of the first murder, how can you use the first murder to prove the 2nd murder

Every one who wilfully and without lawful excuse (a) kills, maims, wounds, poisons or injures dogs, birds or animals that are not cattle and are kept for a lawful purpose, or ( places poison in such a position that it may easily be consumed by dogs, birds or animals that are not cattle and are kept for a lawful purpose, is guilty of an offence punishable on summary conviction. selling defective stores to the military will get you 14 years... does that mean that whom ever sold us the leaky subs got the book thrown at them..? Selling defective stores to Her Majesty 418.   4. ah, ok. on a totally different topic. LF. since pickton was found guilty of 6 counts of 2nd degree murder the automatic sentence is life, but can apply for parole in 10 years. that doesnt mean he will be allowed out. he may still be found to be a dangerous offender and may sentance to an indetermanent amount of time. but from what i have read, the application has to be made prior to sentancing. now at sentancing and depending on how this works... if the person has been convicted of a previous murder then the second murder and so on, shall not have parol for 25 years if guilty of 2nd degree murder. but i'm not sure how it works, if the previous murder has to be part of a different trial or not. of course olsen has been applying every time he can and has been denied. pickton still has to go through the sentancing process and can be given either consecutive life sentances or concurrant. Canada has a habit of doing concurrent. i prefer the US system, like dalmer... something like 23 consecutive life sentances which he would have spent something like 381 in jail. lol. why canada doesnt do that is beyond me. interesting that he wasnt found guilty on first degree - from Criminal code (5) Irrespective of whether a murder is planned and deliberate on the part of any person, murder is first degree murder in respect of a person when the death is caused by that person while committing or attempting to commit an offence under one of the following sections: (a) section 76 (hijacking an aircraft); ( section 271 (sexual assault); © section 272 (sexual assault with a weapon, threats to a third party or causing bodily harm); (d) section 273 (aggravated sexual assault); (e) section 279 (kidnapping and forcible confinement); or (f) section 279.1 (hostage taking). Punishment for murder 235. (1) Every one who commits first degree murder or second degree murder is guilty of an indictable offence and shall be sentenced to imprisonment for life.

  7. i kind of like the status quo. sorry rickr, for the most part, many of the americans i have met (i lived there also) are loud and obnoxious. las vegas is a nightmare. and everywhere they travel, they let you know where they are from, whether you care or not.

  13. OMG, how about the 300+ days of fishing... how is she with that?? Rick, i think you covered it. get your canadian passport, then you can go to cuba. i'm thinking next winter. do you need a passport for cuba? i know the DMR you dont. my girlfriend got in to the domincan with her Costo card - it was the only picture id she had with her. LOL
  14. i feel sorry for the family. i cant believe the truck driver refused to blow. it's too bad 5 other people (plus family) had to pay for 1 guys stupidity. at least he (if found guilty) will probably lose his license for many years. if he doesnt go to jail, he wont have much of a life
  15. all i know is the cuba missle crisis pissed off the states in a big way and brought in the trade embargo. as for why they havent changed that is unknown to me

  18. no problem. if you are considering going to Cabo, ask someone who has been recently. i have been there twice, but both times were 8 years ago. i havent been a travel agent in 7 years. both times the same areas were still under construction 3 years apart. i got the feeling that there was not a lot of progress. Cabo san lucas is more touristy than san jose, there are a number of nice hotels but no all inclusives, can get expensive. you look at the marinas. head south and fish at the arches from the beach. someone on the forum just came back but i dont remember who. Nuevo was nice, but away from PV, you can take the bus in but limited on times and almost always had to take a taxi back. again it has been 7 years since i was there. there may be more build in nuevo as they were trying to address the north end of PV for tourists, but as always, if you want to party or shop everyday, downtown is the place to be. the tourist zone on the beach just outside of town is very nice. i think my biggest complaint is the pacific ocean, whether you are in vancouver, anchorage los angeles or PV, it all looks the same. the only exceptions that i have found are hawaii and aucapulco. sort of a greyish bluey green, poor visibility. yes the pacific destinations are less expensive, the charter flights go every week year round to most places but you get what you pay for. it is great if all you want to do is lay on the beach and drink, or for cabo - golf... now somthing to think about for similar cost is cuba. dont go below a 4 star, but it is supposed to be amazing, the people are great, the food is average and not a lot of flavour but i have heard that is also changing. tip well and you are treated like royalty. fishing is supposed to be fantastic. you can bring home the cigars and smoke them in front of your american friends and laugh. oh wait, that's me. they get touchy when you do that.

  20. well i'm doing a cruise in jan, leaving from Miami, doing cozumel for 2 days and then grand cayman and coco cay. it's for work so i know you all feel sorry for me... ok Lynn, Mexico from an ex- travel agent... destinations - Cabo - Golf, golf and more golf. there is a lot of drinking and some deep sea fishing, but mostly golf. cabo is separated in to 3 areas. cabo san lucas, san jose del cabo and the corridor. last time i was there, the only all inclusive was at the north end of the corridor next to the estuary. i dont golf as a destination recreation, so all i did was sun tan and drink. the taxi rides leave a lot to be desired and the corridor is not exactly close to cabo and san jose is really not that interesting, even the shoping was not that great. same can be for la paz as a destination, both look a lot like a half built california stage coage stop from the spaghetti westerns still under set consturction. la paz has more grass, less touristy stuff. Sanora bay/ san carlos/guymyus - north end of the baja on the mainland. fishing town, club med and that's about it. weather is not as good. 3000 people in the summer blooms to about 10000 in the winter, mainly americans from arizona (because they need a winter get away ) mazatlan - i have not personally been. so this is second hand info from clients and collegues. great party town if you are 20. excellent deep sea fishing oppertunities. drink and fish. but the fishing can be expensive, expect to pay between 350 - 500 usd per person for a 1/2 day charter - fish not guaranteed and we all know guides are not created equally. the tourist zone is good for shopping food and nightlife. the city is dirty. my mom and another girlfriend of mine both like a little town to the north, i think it starts with a b, but it is basically a gated condo community, dont expect tourist stuff like going out for dinner or dancing to the wee hours that you would have in mazatlan (the town is something like bochos rios ???) benefit is that mazatlan otherwise is less expensive to get to and one you get there off all of the pacific destinations. you will notice the lack of quality in accommodations and food. so either look at a 5 star all inclusive or a 3 star hotel only and spend the time doing other things and eating other places - and by you booze where the locals do... not the night clubs Puerto Vallarta. again split in to 3 or 4 sections depending on who you talk to. nuevo, marina, old vallarta and somthing i cant spell (blue bay in the town that begins with M, phonectically in english spelled - mis mal loi a.) my 2 trips to PV were very fast. destination - beach and drinking. great sight seeing oppertunities, like horse back riding on the beach. fishing, but not as big. beach is unprotected from the pacific. good party town, old vallarta is basically down town, good shopping a few deals to be had, bartering was good. english not a problem but starting to get a little more difficult from the others. if you are going to do an all inclusive, take one on the beach in any district, but remember transportation between nuevo and marina vallarta to downtown is limited to peso buses and taxis. peso bus is cheap but not reliable. taxi expensive and only kind of reliable. the farther out you are does not mean the less expensive it is. there really is not much to do in nuevo or marina. overall pv was fun, cleaner than some cities, great night life and good shopping. manzanillo - mosquito central (NWT of the south, rivals the size of winnipegs) built on a marsh, of course...because someone thought that would be a great place to put a resort. i personally would not bother with manzanillo, even if just for the bugs. but also because it was not really a town before but a created destination. all tourist all the time, well sort of. i have heard the fishing is good. but dont have any specific info for you. if you feel you must go south, either keep going or stop 45min north at playa blanc (club med) great resort, lots to do, isolated, no mosquitos, adult club only - so no kids. very relaxed atmosphere and the food is fantastic. or if you want to do a back pack style - try barra de navidad, quaint little town just south, mom and pop hotel on the beach for 40usd a night, this is a rural beach mexico town, no tourist activities - bring the dictionary. ixtapa/zihuatanjo - biggest complaint - unprotected beach and big surf, that's the reason why they get such good pics of an empty beach. the waves are too high and every one is at the pool. good luck getting a chair. fishing supposed to be getting better the farther south you go. again, lots of typical tourist stuff, starting to get more expensive. dont cheap out on the hotel, not much to do and not a lot of food options in zihautanajo, more local towns people stuff, ixtapa more for tourists but away from the town. Hualtulco - about all i know is that it is a fairly new destination in the last few years and there is a great club med family club there. so the local infrastructure might not be great yet for tourists and there may be a lot of people milling about with not much to do. again the beaches are unprotected. Acupulco - the jewel of the pacific. - go here. this is a must at somepoint. excellent night life, excellent food. beautiful city. most expensive on the west coast but amazing. fishing is to die for, protected beaches. very crowded (but this could have changed as more destinations have opened) this is what pv has tried to be. i gather you have been to the east coast a few times. so wont bother going in to detail. all the destinations were specifically created for the american tourists. lots to do, lots of adventure options from scuba to ruins. waters are protected because of the gulf, just dont go in hurricane season. adult club med in cancun. tourist stop on cozumel. maya is secluded and beautiful all inclusive needed, good tour options. hope that helps...

  23. ooo shiny, i'd try em... the gimmick could work, just think, a few more angles to reflect light off of. or it's just a gimmick and doesnt work at all... but that's ok, it's shiny
  24. in answer to the other question. i use the same rods, reels and lines year round. no cracks in the fly line yet, but i also dont fly fish that much in the winter. just dont leave your wet icy gear in the vehicle when it's -20. take it inside, get it warm, dry and cleaned up you should be golden. you could also try the southland dog park or enter from carburn park in river bend or the far east end of 46th SE below the other sewage treatment plant
